Once again the village president and trustees have disagreed over candidates for village attorney.

At a board meeting Monday night Village President Marshall Reagle said he will formally appoint John Pieper, a Wheaton lawyer and former village attorney for Villa Park, to the job this month.

But Trustee Karen Darch recommended that Reagle nominate James Bateman, a lawyer already doing some business for the village. Darch also said Bateman charges $125 an hour and Pieper charges $185.

Reagle said he would consider the recommendation.

Reagle has sued the trustees over who has the power to appoint the village attorney. A Cook County Circuit judge decided in June that Reagle should nominate the village attorney with the advice and consent of the trustees. His first nominee was not approved.

On Sept. 3 Reagle filed another suit against the trustees, arguing that six law firms improperly were hired for village business because the village president had no input. A hearing before Circuit Judge David Donnersberger is set for Oct. 12.
