The Illinois Supreme Court on Wednesday denied DuPage County State’s Atty. Joseph Birkett’s efforts to reverse an Appellate Court decision that freed Donna Gist, convicted of the 1996 murder of a Winfield infant, from prison.

“For now, justice has been denied,” said Birkett, adding that he willask the Supreme Court to reconsider its denial.

Gist, a nurse’s aide, was convicted of the murder of 5-month-old Matthew Hendrickson in his family’s home while she was caring for him.

The Appellate Court ruled last year that the jury’s verdict was incorrect and released Gist from prison instead of calling for a new trial.
