A Kane County judge Tuesday found 26-year-old Shaun Judge guilty of murder in the 1993 shooting of his pregnant ex-girlfriend.

After a weeklong bench trial, Judge Melvin E. Dunn rejected defense arguments that the shooting of 20-year-old Peggy Lee Richardson was provoked either by Judge’s intoxication at the time or by behavior on Richardson’s part.

“Even if he had seen Richardson and (boyfriend) Herman Glass together, that’s not sufficient provocation,” Dunn said.

On Aug. 22, 1993, Judge, who according to testimony had consumed more than 150 ounces of alcohol, saw Richardson, 20, and her new boyfriend at the Aurora apartment complex where they all lived.

When Richardson refused to speak to him, Judge pulled a gun and shot her twice in the head. He then fired at the fleeing Glass, striking him in the shoulder.

A hearing is scheduled for June 16 on a defense motion to preclude prosecutors from seeking the death penalty against Judge.
